Refund Policy
1. Service Nature
BluePSolution provides professional consulting, strategic advisory, and digital infrastructure services. Due to the bespoke and customized nature of our deliverables, refunds are evaluated on a case-by-case basis in accordance with the following terms.
2. Cancellation Before Work Commencement
If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days. Cancellation must be communicated in writing to [email protected].
3. Cancellation During Active Projects
If a project is cancelled after work has commenced, BluePSolution reserves the right to retain payment proportional to the work completed up to the date of cancellation. A detailed breakdown of completed work phases will be provided. Any unused portion of the advance payment will be refunded within 14 business days.
4. Defective Deliverables
If delivered work materially deviates from the agreed-upon specifications documented in the project brief, BluePSolution will, at its discretion: (a) rectify the deliverable at no additional cost; (b) provide a partial refund proportional to the deficient component; or (c) issue a full refund if the defect cannot be remedied within a reasonable timeframe.
5. Refund Request Procedure
To initiate a refund request, contact [email protected] with your project reference number, a description of the issue, and supporting documentation. All refund requests will be reviewed and resolved within 20 business days of receipt.
Terms of Service
1. Acceptance of Terms
By accessing or using the services provided by BluePSolution, registered at C. Magallanes 12, Elda, Alicante, Espana, you agree to be bound by these Terms of Service. If you do not agree with any provision, you must discontinue use of our services immediately.
2. Scope of Services
BluePSolution provides strategic consulting, workflow optimization, market analysis, brand development, and digital infrastructure services. The specific scope, deliverables, timelines, and fees for each engagement are defined in a separate written agreement or project brief mutually executed by both parties.
3. Client Obligations
The client agrees to: (a) provide timely access to all information, materials, and personnel reasonably necessary for project execution; (b) designate an authorized decision-maker with binding authority for project approvals; (c) respond to information requests within 5 business days to prevent schedule delays.
4. Payment Terms
Unless otherwise specified in the project agreement: (a) a 50% advance payment is required before work commences; (b) the remaining 50% is due upon delivery of final deliverables; (c) invoices are payable within 14 calendar days of issuance; (d) late payments incur a 1.5% monthly interest rate.
5. Intellectual Property
Upon full payment, the client receives a non-exclusive, perpetual license to use all deliverables produced under the project agreement. BluePSolution retains the right to use anonymized case studies and portfolio examples for marketing purposes, unless the client explicitly objects in writing.
6. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information exchanged during the engagement. This obligation survives termination of the service agreement for a period of 24 months.
7. Limitation of Liability
BluePSolution's total aggregate liability under any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. BluePSolution shall not be liable for indirect, incidental, consequential, or punitive damages.
8. Termination
Either party may terminate the service agreement with 14 days' written notice. In the event of termination, the client shall pay for all work completed up to the termination date. Provisions relating to confidentiality, intellectual property, and limitation of liability survive termination.
9. Governing Law & Jurisdiction
These Terms of Service are governed by the laws of Spain and the European Union. Any disputes arising from or relating to these terms shall be submitted to the exclusive jurisdiction of the courts of Alicante, Spain.
